Berm case heads to King County Superior Court

SNOQUALMIE - The Snoqualmie City Council unanimously voted to appeal a recent ruling by a King County hearing examiner to King County Superior Court.

SNOQUALMIE – The Snoqualmie City Council unanimously voted to appeal a recent ruling by a King County hearing examiner to King County Superior Court.

The vote came after nearly 4 years of efforts to get the King County Department of Development and Environmental Services (DDES) to make the Weyerhaeuser Co. remove a fill yard and berm along the Mill Pond Road. The city has claimed that the berm was built without any of the necessary permits from the State Environmental Protection Act (SEPA) or King County. It has argued that the fill yard and berm aggravates flooding in the city of Snoqualmie.

The city first filed a complaint with DDES to get Weyerhaeuser to remove fill within the log sort yard at the Snoqualmie mill site and a surrounding berm in 1999. That initial request was denied in 2001 and the city appealed the ruling, which was again denied in 2002. That ruling was appealed to a hearings examiner who ruled against the city in January of this year. Snoqualmie appealed the hearing examiner’s decision for reconsideration and was denied in February.
